These terms and conditions apply to the use of this website and by accessing this website you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this website

JustBooked is a trading name of Manage My Booking Limited and offers the service of collecting information and payment as required on behalf of event organisers. JustBooked act on behalf of the event organiser and therefore are not responsible for the Event.
1. Definitions
“Events” events organised by Event Organisers and which are facilitated by us through JustBooked
Website
“Event Attendee” means a User who registers on JustBooked Website to attend an Event.
“Event Organiser” means a User who registers on JustBooked Website to organise an Event.
“User” means any user of JustBooked Websites including Event Organisers and Event Attendees.
“JustBooked” this service provided by Manage My Booking Ltd and its subsidiaries
“Third Party Data Providers” Third parties who license their data to be used by JustBooked
“We/Us” Manage My Booking Ltd trading as JustBooked, Company Registration Number, 6993033 of
Sterling House, Brunswick Industrial Estate, Wideopen. Newcastle upon Tyne. Ne13 7BA
“You” the User
“Trust” – a client deposit account that is fully insured were all monies are held before transferring to the
Event Organiser
“Ticket” – cost to attend an event
2. As an Event Organiser you agree to:-
2.1 Provide true accurate and complete information that you are required to provide to register as a
user of JustBooked to manage your event
2.2 Notify us immediately of any change to the user information
2.3 Have the permission of all your guest list to use their personal information including email
addresses and contact telephone numbers before uploading their details to JustBooked
2.4 Not to impersonate any other person or entity or to use a false name or a name that you are
not authorised to use
2.5 Paid Events -inform all guests that all money paid to JustBooked in return for a ticket is non-
refundable. If guests are no longer able to attend the event then a refund is at the discretion of
you, the event organiser. A refund can only be paid from the event organiser once the event
deadline has passed and the funds are transferred in to your, the event organisers bank account.
JustBooked are unable to refund your guests
2.6 Paid Events - a booking fee is payable which can be added in to the cost per ticket or can be
added on top of each ticket
2.7 Nonpaid Events – pay an amount per person on your guest list in the form of a management fee
and pay per person you invite additionally once the event has been set up.
2.8 Informing us by email if you cancel your event, all monies collected and held in trust will be
forwarded to you within 10 working days of cancellation. It is then your responsibility to refund
monies to your guests.
2.9 Under no circumstances can JustBooked refund directly to your guests
2.10 Allow 5 working days to transfer funds for your event in to your bank account.
3. As an Event Attendee you agree to:-
3.1 Provide true accurate and complete information that you are required to provide to register as a user
of JustBooked to attend an event
3.2 Notify us immediately of any change to the user information
3.3 Not to impersonate any other person or entity or to use a false name or a name that you are
not authorised to use
3.4 Paid Events - pay a booking fee to attend event. This may be included in the ticket price or may be
added on to the ticket price. This is at the discretion of the Event Organiser in which way they want
to do it.
3.5 Paid Events –All monies paid to attend an event in the form of a ticket are non refundable. If you are
no longer able to attend the event then a refund is at the discretion of the event organiser. A refund
can only be paid from the event orgainiser once the event deadline has passed and the funds are
transferred in to the event organiser’s bank account.
3.6 Paid Event - paying a booking fee per ticket purchased
4. Provision of Services
4.1 JustBooked expects to be available 24 hours per day, 365 days per year
4.2 The service provided is defined in Annex 1
5. Registration
5.1 You agree to:-
5.1.1 Provide true accurate and complete information that You are required to provide when You
register as a User of JustBooked
5.1.2 Notify us immediately of any change to the user information
5.2 You agree not to impersonate any other person or entity or to use a false name or a name that you are
not authorised to use
5.3 We reserve the right at our sole discretion to decline any application from You to register as a User of
JustBooked
5.3.1 If You are accepted You will receive a user name and password
5.3.2 You will be allowed to select your own password. However if We feel in our sole opinion that
such password infringes or violates the rights of any person or third party is defamatory or
offensive or is in any way inappropriate We reserve the right to modify such or provide You
with a password of our choice.
5.4 You will receive confirmation that your account has been activated by email.
6. Payment and Pricing
6.1 The pricing and payment terms associated with the use of JustBooked are explained at Annex 2. You
are advised to read Annex 2 carefully because when You use particular JustBooked services You will
be committing to pay the then current price and to make payment using the payment methodology for
the particular service selected.
6.2 We reserve the right to review and amend the JustBooked Prices for using JustBooked at any time
subject to 14 days notice
7. Privacy
7.1 We will comply with all relevant English Data Protection Laws so any personal details to be provided
to Us will not be disclosed to third parties without your consent
7.2 However We will disclose personal data in the following circumstances:
7.2.1 If We are requested to do so by a regulatory body or a government authority in investigating
illegal activities or otherwise as authorised by law
7.2.2 If We are compelled to do so by law
7.2.3 Where in our sole opinion We believe an emergency potential illegal activity or some other
reasonable basis exists for doing so
7.3 By using this website we will ask you to input and will collect personal information from you such as
your name, email address, billing address, telephone number, debit or credit card or other payment
information and a password. We may also collect information about where you are in the internet
(eg the URL you came from, IP address, domain types like .co.uk and .com) your browser type the
country and telephone area code where your computer is located, the pages of the website that were
viewed during your visit the advertisements you clicked and any search items you entered on our
website (“User Information”). We may collect this information even if you do not register with Us
7.4 You should be aware that this site is being monitored and may capture information about your visit
that will help us improve the quality of our service
7.5 You agree that you do not object to US contacting you whether by telephone or email or in writing and
You confirm that you do not and will not consider our contact as being a breach of any of your rights
under the Privacy and Electronic Communications (EC Directive) Regulations 2003
7.6 Your personal information may be disclosed to other businesses within Manage My Booking and to
reputable third parties who will help process your orders. We require all such third parties to treat your
personal information as fully confidential and to fully comply with all applicable UK Data Protection
and consumer legislation from time to time in place. We will not release your personal information to
any company outside of Manage My Business for mailing or marketing purposes
8. Your obligations
8.1 You are responsible for:
8.1.1 Procuring the necessary equipment and the payment of telephone charges necessary to access
JustBooked
8.1.2 All use activity and charges associated with or arising out of your use of JustBooked including
any unauthorised charges or use by a third party using your subscription user name and/or
password
8.1.3 Making reasonable inspection of JustBooked services to satisfy yourself that there are no
apparent defects or failures. Subject to as otherwise provided herein. We will not accept
responsibility for any defect or failure notified more than 7 days after discovery by You
8.1.4 All judgements and decisions that You may make as a result of your use of JustBooked
8.1.5 Any Data You transfer or receive through JustBooked
8.1.6 Informing Us of any change to your situation
8.1.7 Your use of any hyperlinks to other Web sites provided by JustBooked and should You obtain
information directly therefrom, You are hereby advised that such usage will be subject to both
these terms and conditions and the terms and conditions appertaining to the site accessed via
the hyperlink. In cases of conflict these JustBooked terms and conditions shall take precedence
8.1.8 Deploying and maintaining current industry virus protection standards and have thereby taken
all reasonable precautions to ensure that You do not allow any party directly or indirectly to
upload transmit or distribute computer viruses worms macro viruses Trojan Horse or similar
programs
8.2 You agree not to use or allow any party to use JustBooked directly or indirectly:
8.2.1 For any illegal or malicious purpose
8.2.2 To use the service in connection with marketing surveys contests pyramid schemes chain
letters junk email or any duplicative or unsolicited messages (commercial or otherwise)
8.2.3 To defame abuse harass stalk threaten or otherwise violate the legal rights (such as rights of
privacy and publicity) of others
8.2.4 To publish distribute or disseminate any inappropriate profane defamatory infringing obscene
indecent or unlawful material or information
8.2.5 To attempt any unauthorised access to any part or component of MMB or that of any third
party
8.2.6 To create a false identity for the purpose of misleading others as to the identity of the sender or
the origin of the message
8.2.7 To use download or otherwise copy or provide (whether or not for a fee) to a person or entity
that is not a client of JustBooked any information or portion thereof other than in the context of
your usage
8.2.8 To transmit or upload any material that contains software or other material protected by
intellectual property rights unless You own or control such rights or have received all the
necessary consents.
8.3 You agree that You are responsible for any non-accredited persons that you allow to use your
subscription user name or password
8.4 You agree not to allow any third party other than non-accredited persons to use your subscription user
name or password
9. Indemnity
9.1 You agree to indemnify Us and our Third Party Data Providers and our respective parent
companies subsidiaries affiliates officers employees and agents harmless from any claim demand
or damage including legal fees asserted by a third party due to or arising out of your breach of
any terms of these Terms and Conditions.
9.2 The indemnifying party shall have the option to assume the defence of any proceedings arising from
the circumstances anticipated by clause 7.1 always provided that indemnifying party shall keep the
other party fully informed of all matters relevant to the progress and settlement of any claim. In the
event that the indemnifying party fails to assume the defence of any such proceedings then the other
party shall have the right to take over.
10. Our rights
10.1 We reserve the right to:-
10.1.1 Deny access to all or any part of JustBooked in the event of breach of these Terms and
Conditions or when We are unable to provide such access due to an event outside our
reasonable control
10.1.2 Close access to any features of the service in the event of breach of these terms and conditions
10.1.3 Modify or discontinue JustBooked either temporarily or permanently with or without notice to
You. Such modifications shall be subject to these terms and conditions.
10.2 Change the Terms and Conditions from time to time
10.2.1 Such changes will be displayed on the website
10.2.2 Your continuing usage of JustBooked will constitute acceptance of the Terms and Conditions
10.2.3 You are solely responsible for ensuring that You are aware of any such changes
10.2.4 We reserve the right to terminate/suspend this agreement immediately and without further
notice if You do not accept such changes
11. Back-up of content
We will retain in archive copies of all Data input to JustBooked for at least 6 years notwithstanding that We reserve the right to delete any matters from direct access via the website if same has not been accessed for a period of 3 months. Should You need to retrieve Data from our archive You should contact Us and such Data can be reproduced subject to an agreed fee
12. Intellectual Property and Right to Use
12.1 JustBooked and all content supplied by Third Party Providers remains the property of JustBooked
and Third Party Providers and is thus copyright with all rights reserved (including Crown Copyright
material)
12.2 You acknowledge that You are permitted to use this material only as expressly authorised by Us or
our licensors and may not copy reproduce transmit distribute or create derivative works or such
material without express written authority
12.3 You agree not to (and agree not to assist or facilitate any third party to) distribute or commercially
exploit such material or content. You will notify Us immediately of any such distribution or
commercial exploitation
12.4 Trademarks logos and service marks appearing on JustBooked are the property of JustBooked or
their Third Party Data Providers. You are not authorised to use these without the prior written
agreement of JustBooked or the applicable third party owner
12.5 Guidelines for use of JustBooked will be posted on the website.
13. Warranties and Limitation of Liability
13.1 We warrant that:
13.1.1 The services We provide under these Terms and Conditions will be performed with
reasonable skill and care in accordance with these Terms and Conditions
13.1.2 We are authorised to provide the services on these Terms and Conditions
13.1.3 The provision of the service will not infringe any third part rights
13.2 To the maximum extent permitted by law We make no representations warranties or conditions of
any kind either express or implied with respect to a Third Party Data Provider’s response to any
request including but not limited to any warranty that the responses are complete accurate of
satisfactory quality or fit for a particular purpose
13.3 You agree that We shall not be liable in contract tort negligence and statutory duty or otherwise for
any loss or damage whatsoever caused by any act or omission of a Third Party Data Provider
13.4 We shall in any event be liable to You for loss of profits or contracts or other indirect or
consequential loss whether arising from negligence breach of contract or howsoever
13.5 You agree that except for death and personal injury arising from our negligence our liability in
contract tort pre-contract or other representations arising out of or in connection with each
transaction completed under this contract shall be limited to £2,000,000.pounds sterling
14. Termination
14.1 Without prejudice to our other rights and remedies We may terminate your account with JustBooked
if:
14.1.1 You fail to make payment within our current terms
14.1.2 We believe in our reasonable opinion that You have fundamentally breached these Terms
and Conditions or acted inconsistently with the spirit of these Terms and Conditions
14.2 You may terminate your account at any time by giving 28 days notice to Us
14.3 We reserve the right to terminate your account without notice (including your user name and
password) if any user information is untrue inaccurate out-of-date or incomplete
14.4 In the event of termination of your account at any time your entitlement to use JustBooked ceases
forthwith at which point all charges incurred become payable immediately
14.5 The limitation of liability and indemnity sections shall survive termination of these Terms and
Conditions
14.6 On termination We will continue to provide You any responses provided by Third Party Data
Providers paid for before the date of such termination
15. Severability
Each provision of these terms and conditions shall be construed separately and deemed to survive even if one or other of those provisions is held to be inapplicable or unenforceable. The terms shall remain in force unless the agreement is terminated
16. No Waiver
No waiver by Us shall be construed as a waiver of any preceding breach of any provision
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties with respect to their subject matter and exclude any representations and warranties previously given or made other than any negligent or fraudulent misrepresentation
18. Choice of Law
English Law shall govern these terms and conditions and You hereby irrevocably submit to the exclusive jurisdiction of the English Courts. Nothing in this clause shall limit our right to take proceedings against You in any other court of competent jurisdiction. The commencement of proceedings in one or more jurisdictions will not prevent Us from commencing proceedings in any other jurisdiction or jurisdictions.
19. Force majeure
We shall not be liable for any delay interruption or failure in performance of our obligations hereunder if caused or contributed to by any circumstance which is outside our reasonable control including (without limitation) war flood riot Act of God strike or other labour dispute (including those affecting Government officials) suspension or delay of services at public registries change in the law lack of power or telecommunications failure
20. Rights of Third Parties
Save in the case of Third Party Data Service Providers no other person who is not a party to any contract made pursuant to these terms shall have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of such contract
Annex 1 – Services
1. JustBooked offers the service of collecting information and payment as required on behalf of Event Organisers.
2. The Event Organiser will set up the event and upload the guest list. We invite the guests and manage the RSVP’s and provide a secure payment facility for guests that have to pay to attend the event.
3. We collect all the information which is requested by the Event Organiser and this is displayed in the Event Organisers account.
4. All monies collected are fully insured through Hiscox Ltd and held in a Client Trust Account with HSBC.
5. JustBooked act on behalf of the Event Organiser and therefore are not responsible for the Event.
Annex 2 - Pricing
JustBooked is FREE for FREE events!
Any type of free events including weddings are FREE no matter the size
JustBooked is FREE to set up events and will only cost when someone buys a tickets or we collect money from your guests on your behalf – Basically when you make a sale!
We charge a small booking cost of 5% of ticket/event price + £1.00. This cost can be included in the event price or added on top. It’s up to you.
So if you don’t charge – We don’t charge!
